1)  The location of a structure at 2100 Triana Blvd SW, Bruce Walker of Walker Properties, LLC, appellant.

·  This request will require a 28 foot 9 inch secondary front yard setback variance in a Light Industry Zoning District.

·  According to Article 40.2.2 of the Zoning Ordinance, a 30 foot front yard setback is required.

2)  A special exception to allow a club house at 4545 River Park Blvd. SE, Daniel Hopkins of Jeff Benton Development for Focus Investments, LLC, appellant.

·  This request will require a special exception to allow a club house in a Residence 1B Zoning District.

·  According to Article 92.5.3 of the Zoning Ordinance, a special exception is required for a semi-public, non-profit, and recreational facilities in any residential district (except miniature golf courses).

3)  The size of a sign at 446 Jeff Road NW, Roy Cox of Trav-Ad Signs for Willowbrook Baptist Church, Inc., appellant.

·  This request will require an additional 58 square feet for a detached sign in a R2A Zoning District.

·  According to Article 72.4.1 (2) of the Zoning Ordinance, detached signs, upon premises occupied by schools, service clubs, churches, hospitals and permitted buildings, provided that the area on one side of any sign shall not exceed forty (40) square feet; and not more than one such sign shall be placed on any premises, unless such premises fronts on more than one street in which case one such sign may be erected along each frontage.

4)  The size and height of a sign at 2238 Cecil Ashburn Drive SE, Scott Hundley of Thrive at Jones Farm, LLC, appellant.

·  This request will require an additional 57.69 Square feet for an accessory ground mounted monument sign in a Neighborhood Business C1 Zoning District.

·  This request will also require a 1 foot 10 inch height variance.

·  According to Article 72.4.2 (5) of the Zoning Ordinance an accessory ground mounted monument sign is permitted a maximum of 35 square feet of total sign size and a maximum height of 6 feet.

5)  The location of a sign at 54 Taylor Road SE, Edward T. Jones, Architect P.C. for Jonathan Pope of On The Cusp Properties, LLC, appellant.

·  This request will require a 39 foot front yard setback variance in a Highway Business C4 Zoning District.

·  According to Article 24.2.4 of the Zoning Ordinance, a 50 foot front yard setback for a monument sign is required.

6)  The location and height of a sign at 13870 Alabama Highway 20 NW, Michael Rodgers of Signs of the South Inc., for Will L. Stewart of Fitzgerald Peterbilt, appellant.

·  This request will require an additional 51.56 Square feet for an accessory ground sign in a Commercial Industrial Park Zoning District.

·  This request will also require a 30 foot height variance.

·  According to Article 72.4.2 (3) of the Zoning Ordinance an accessory ground sign is permitted a maximum of 100 square feet of total sign size and a maximum height of 10 feet.

7)  A special exception to allow an Off-premises Beer/ Table Wine retailer within 500 feet of a protected use at 201 Jefferson Street Unit 5A and 5B NW, Matthew Mell and Stephanie Mell of Southern Urban Vino LLC., appellant.

·  This request will require a special exception to allow an off-premise beer/table wine retailer located within 500 feet of a church in a General Business C3 Zoning District.

·  According to Article 92.5.3 (2) of the Zoning Ordinance, a special exception is required for Off-Premises Beer/Table Wine Retailers when located 500 feet of a church in a General Business C3 Zoning District.

8)  The location of a structure at 6700 Odyssey Drive NW, Tracy Hunter of NAI Chase Commercial Real Estate Services, Inc. for FGH Park Place Associates, LLC, appellant.

·  This request will require a 16 foot 4 inch side yard setback variance to allow the replacement of a HVAC cooling tower.

·  According to Article 51.3.2 of the Zoning Ordinance, all other yards shall have a minimum depth of fifty (50) feet, provided that no building shall project through an imaginary height plane as described in Section 51.8.2.

9)  A variance for the size and to allow additional plumbing fixtures for a pool house at 38 Asbury Road SE, Lee Austin of Durable Designs for Roddie Gantt and Michelle Gantt, appellant.

·  This request will require a variance to allow additional plumbing fixtures and additional square footage for a detached pool house.

·  According to Article 3.1 of the Zoning Ordinance, A supplementary structure detached from a principal building on the same lot and customarily incidental and subordinate to the principal building or use containing no plumbing facilities other than one laundry sink and/or one toilet, and meeting the requirements of Section 73.8 with the exception that, plumbing facilities may be allowed in an accessory structure that is used as a bath house in conjunction with a swimming pool, provided such bath house does not exceed 180 square feet in area.

·  This request will require a special exception to allow expanded hours of service for on-premise alcohol sales until 2:00 a.m. Expanded hours for on-premises retail sale, service, dispensing, or consumption of alcoholic beverages in a Neighborhood Business C1 Zoning District between midnight and 2:00 a.m. are permitted by special exception provided the conditions of Article 92.5.3 (18) have been met.
