INSTRUCTIONSTOBIDDER
1.1The Idukki District Cooperative Bank Ltd.(hereinafter referredtoastheBank)hasanetworkof54branchesinthedistrict of Idukki. The Bank intends to printing calendar, diary and Table Calendar and planner for the year 2018. For this purpose, theBankissues this tender document from its Head Office Idukki Colony P.O at Cheruthony, Idukki.
1.2TheBankintendstoshortlist3 competent solutionprovidersonlowestbidder(L1, L2 & L3)basis (Chargesquotedinannexure-B)forprovidingtheaboveservices.
1.3Technicaland commercialbidsforthe solutionareinvitedfromproviderswhocanexecutetheprojectasperthetermsandconditionsmentioned hereunder.
2. ELIGIBLEBIDDER:
ThisinvitationofbidsisopentoallserviceprovidershavingpresenceinIndia,provided theyfulfillthe minimumqualificationcriteria asmentioned inclause 3.
3. ELIGIBILITYCRITERIA:
3.1 Thebiddershouldhaveatleast2yearsexperiencein implementingsuch projects, of which oneshouldbeinaBank.
3.2TheBankreserves theright torejecttechnicalor commercialproposalofthebidderat anystage ofthe evaluationprocess.
4. SCOPE OF WORK:
4.1 The Bank intends to select a competitive and cost-effective company for printing and supply of Calendar, Diary, Table Calendar and Planner for the year 2018.
4.2 The Bank will provide the design of the items to be printed.
4.3 The rate quoted must be for the printing and supply of Calendar, Diary, Table Calendar and Planner for the year 2018 separately in Annexure B
4.4 Specification of the items to be printed will be as mentioned below:

5. COST OFBIDDING:
Cost of the document is Rs.1,000/- + STG by DD in favour of General Manager IDCB payable at Idukki and should be submitted along with the tender document. The tender document is non-transferrable.
5.1Thebiddershallbearallthecostsassociatedwiththepreparationandsubmission ofbidandBankwillinnocaseberesponsibleorliableforthesecosts regardless of theconductoroutcome ofthebiddingprocess.
5.2Thebiddershalldeposit EMD with tender document intheformofademanddraft favoringIdukki District Cooperative Bankand payable at Idukki along with the biddocument as detailed below.

6. BIDDINGDOCUMENT:
The Bidder is shouldto examine all instructions, forms, termsandconditionsandtechnicalspecificationsinthebiddingdocument.
SubmissionofabidnotsubstantiallyresponsivetotheBiddingdocumentwillbeatthebidder’s riskandmayresultintherejectionofitsbidwithoutanyfurtherreferencetothebidder.
7.AMENDMENTSTOBIDDINGDOCUMENTS:
7.1Atanytimepriortothedeadlineforsubmissionofbids,theBankmay,foranyreason,modifythebiddingdocumentbyamendmentsatthesolediscretionoftheBank.
7.2Allamendmentswillbeinformed to the purchasers of this document by email.Forthispurpose,Biddersmustprovide their contact email ID at the time of purchasing the document.
7.3In order to provide prospective bidders reasonable time to take theamendmentintoaccountinpreparingtheirbid,theBankmay,atitsdiscretion,extend thedeadlinefor submission ofbids.
7.4Allclarifications/amendmentsshouldbesoughtfromtheBankwithin5days ofadvertisementoftheinvitationofbids.Afterthis,noclarifications/amendmentswill be entertainedby theBank.
8. PERIODOFVALIDITY:
Bidsshallremainvalidfortwo monthsfromthedateofbidopeningprescribedbytheBank.AbidvalidforshorterperiodshallberejectedbytheBankasnon-responsiveandwouldbeliablefor rejection.
9. BIDCURRENCY:
Prices shallbeexpressedinIndianRupees only.
10. BIDDINGPROCESS(TWOSTAGES)
10.1Forthepurposeofthepresentjob,atwo-stagebiddingprocessshallbefollowed. Theresponse tothepresent
tender willbesubmitted intwo parts:
•Technicalbid–Part-I
•CommercialBid–Part-II
Thebidderwillhavetosubmitthetechnicalbidandcommercialportionofthebidseparately insealed envelopes dulysuperscribing “TENDER FOR CALENDAR”and“COMMERCIAL BID”as thecasemaybe.
10.2 Technical Bids:
i)Technicalbidwillalsocontainthebidder’sinformationintheformat giveninAnnexure- A
ii)Technicalbidwillnot contain anypricingorcommercial information.
iii)Thebidshallbetypedorwritteninlegibleinkandshallbesignedbythebidderorapersondulyauthorizedbythefirm.Allpagesofthebidshallbesignedbytheperson(s)signingthebidandshould alsobeproperlynumbered.
iv)Thebidshallcontainnointerlineations,erasuresoroverwritingexceptasnecessary tocorrecterrorsmadebythebidder,inwhichcasecorrectionsshallbeinitialedbytheperson(s)signingthe bid.

12. LAST DATEFORSUBMISSIONOFBIDS:
12.1BidsmustbesubmittedtotheBankattheaddressspecifiedinthebiddocumentnotlater than 07-10-2017 upto5 PM.In theeventofthespecifieddateandsubmissionofbidsbeingdeclaredaholidayfortheBank,thebidswillbereceiveduptothe appointedtime on thenext workingday.
12.2TheBankmay,atitsdiscretion,extendthisdeadlineforsubmissionofbidsbyamendingthebiddocuments,inwhichcase,allrights and obligations of the Bank andbidders previouslysubject to thedeadlinewillthereafterbesubjecttothe deadline extended.
13. LATEBIDS:
AnybidreceivedbytheBankafterthedeadlineforsubmissionofbidswillberejectedand/or returnedunopenedtothebidder.
14. MODIFICATIONSAND/ ORWITHDRAWALOFBIDS:
14.1Bidsoncesubmittedwillbetreated,asfinalandnofurthercorrespondencewill beentertained onthis.
14.2Nobidwillbemodifiedafter thedeadlineforsubmissionof bids.

16. PRELIMINARYEXAMINATION:
16.1TheBankwillexaminethebidstodeterminewhethertheyarecomplete,whether anycomputational errorshavebeenmade,whether requiredinformationhasbeenprovidedasunderlinedinthebiddocument,whetherthedocumentshavebeen properlysigned,andwhetherbidsaregenerallyin order.
16.2Thebiddeterminedasnotsubstantiallyresponsivewillberejectedbythe Bank.
17. BIDOPENINGANDEVALUATION:
17.1TheBankwillopenthetechnicalbids,inpresenceofbidderrepresentativeswhochooseto attend,atthetimeanddatementionedinbiddocumentattheaddressmentionedatclause-11 titled “submissionof bids”.
17.2 The bidder’s representatives who are present shall sign a registerevidencingtheir attendance.Intheeventofthespecifieddateofbidopeningbeingdeclareda holiday for Bank, thebidsshallbe openedattheappointed time and placeonthenextworkingday.
17.3Inthefirststage,onlyTECHNICALBIDshallbeopenedand evaluated. Bidders satisfying thepre-qualification criteria/technicalrequirementsasdeterminedby theBank and accepting thetermsandconditionsofthisdocument shall be short-listed.Inthesecond stage,theCOMMERCIALBIDoftheshortlistedbidders willbeopened.
18. SELECTIONOFL1 VENDOR
CommercialbidsofthebidderswhosetechnicalbidsarefoundsuitablebytheBankshallonlybeopened.The lowest bidder shall be identified based on the rates quoted. The L2 bidder will have to match the price for the L1 bidder in order to be selected. In this regard, Bank’s decision will be final.
19. CLARIFICATIONOFBIDS:
Toassistintheexamination,evaluationandcomparisonofbids,theBankmay,atitsdiscretion,askthebidderforclarification.Responsetosuchrequestshallbeinwriting;howevernochangeinthepriceorsubstanceofthebidshallbesought,offered orpermitted.
20. CONTACTING THEBANK during Bid processing
Any effort by bidder to influence the Bank in the bid evaluation, bidcomparisonorcontractawarddecisionmayresultinrejectionofthebid.Bank’sdecisionwillbefinalandwithoutprejudiceandwillbe bindingonallparties.
21. BANK’SRIGHTTOACCEPT ORREJECTANYBIDORALLBIDS
21.1TheBankreservestherighttoacceptorrejectanybidandannulthebiddingprocessandrejectallbidsatany timepriortoawardofcontract,withouttherebyincurringanyliability totheaffectedbidderorbiddersoranyobligationtoinformthe affectedbidderorbiddersofthegroundfortheBank’saction.
22. SIGNINGOFCONTRACT:
22.1Thesuccessfulbidder shallberequiredtoenterintoacontractagreement (SLA)withthe Bank,within 2 days oftheawardofthetenderorwithinsuchextendedperiodas maybespecifiedbytheBankbutbeforestartoftheservices bythevendor.
22.2 Thepriceandother termsandconditionsasagreedbetween thesuccessfulbidder and Bank shallbe valid fora period of two monthsfrom thedate ofagreementwiththeBank.
23. GOVERNINGLAWANDDISPUTES:
23.1Alldisputesanddifferenceswhatsoeverarisingbetweenthepartiesoutoforinrelationtotheconstruction,meaningandoperationoreffectofthesetenderdocumentsorbreachthereofshallbesettled amicably.Ifhoweverthe parties arenotabletosolvethemamicably,thesameshallbesettledbyarbitrationinaccordancewiththeapplicableIndianLaws,andtheawardmadeinpursuancethereofshallbebindingontheparties.TheArbitrator(s)shallgivea reasoned award.AnyappealwillbesubjecttoexclusivejurisdictionofthecourtsofIdukki, Kerala stateonly.
23.2TheServiceProvidershallcontinuetoworkunderthecontractunderthearbitrationproceedingsunlessotherwisedirectedinwriting by theBankorunlessthematteris such that thework cannot possiblybecontinueduntilthe decision ofthearbitratoror umpire, as thecasemaybe,is obtained.
24. USE OFCONTRACT DOCUMENTANDINFORMATION:
Thesuppliershallnot,withouttheBank’spriorwrittenconsent,makeuse of any document or information provided by the Bank in bid document orotherwise exceptforpurpose of performingcontract.
25.ASSIGNMENT:
Thesuppliershallnotassign,inwholeorinpart,its’ obligations tootherfirm /companytoperformunderthecontract,exceptwiththeBank’spriorwrittenconsent.
26. PLACEMENT OF ORDERANDACCEPTANCE:
26.1Theserviceprovidershallgiveacceptanceoftheorderplacedonit,totheheadoffice,within3daysfromthedateoforder,failingwhich;theBankhastherighttocanceltheorder.
26.2Orderswouldfirst be placedontheL1vendorand would be given to the L2 vendor only if the L1 vendor expresses itshelplessnessinprovidingsolutionorbankdecidestocancel the orders placed upon the L1 vendor.
26.3 PAYMENT
On printing and supply of entire lot of specified quantity of calendars and diaries to Head Office against submission of Proof of delivery from Bank
26.4Transportation/Delivery
The Diaries are to be packed in packets of 10 diaries in a packet and again packed in six ply corrugated carton boxes duly covered with polythene sheets and dispatched to Head Office of the bank, Idukki. (Box 20 Kg). No packing material/packing charges will be provided/paid by the Bank. The entire quantity of diaries and calenders is to be printed and despatched within 30 days from the date of print order.
27. DEFECT INTHESUPPLIER’SPERFORMANCE:
Anydefectordelayinprovidingtheservicesasmentionedabovewill lead topenalty.
28.PENALTY FOR DELAY IN DELIVERY
5%of the total amount will be charged as penalty for the delay in supply for each week.
29. LIQUIDATEDDAMAGES:
If the provider fails to perform services within stipulated time schedule,theBankshall,withoutprejudicetoitsotherremediesunderthecontract, cancel the order and claim liquidated damages@10%ofthecharges.
