This Procedural Guide was revised, as well, to reflect that the law, under specific circumstances, considers HIV testing and treatment to fall under the umbrella of Emergency Medical Treatment, allowing the ability of the CSW to authorize said testing and treatment.

This Procedural Guide was revised, per the following legislative changes that became effective January 1, 2014: Health and Safety Code 121020 – permits the CSW to consent to HIV testing and treatment for infants 0-12 months old; defines the treatment as emergency medical care and; requires the CSW to provide contact information for the biological mother to the physician.

0070-548.07 ASSESSING THE SAFETY AND RISK OF NEWBORNS FOR FAMILIES ALREADY UNDER DCFS SUPERVISION

Summary of revisions made:

This Procedural Guide was revised to comport with legislative changes (H&S Code 121020) that, in specific instances: a) permit the CSW to consent to HIV testing and treatment for infants 0-12 months old; b) defines the treatment as emergency medical care and c) requires the CSW to provide contact information for the biological mother to the physician.

0400-503.10 CONTACT REQUIREMENTS AND EXCEPTIONS

Summary of revisions made:

This Procedural Guide was revised to reflect changes to Welfare and Institutions Code 16516.5 and .6, as it pertains to requirements for monthly home visits. The change reflects that at least 50% of monthly visitation with a child in a group home or licensed, certified or approved foster home must take place in the residence, regardless of whether the child requests the visit outside the home. The CSW is also required to make contact with the caregiver in person or by phone, monthly.

0600-514.10 Psychotropic Medication: Authorization, Review and Monitoring for DCFS-Supervised Youth

Summary of revisions made:

This Procedural Guide was revised to align with 0600-501.10, Medical Consent by providing: Clarification as to when a nonminor dependent (NMD) may consent for his/her psychotropic medication and when court authorization is required and; instruction for steps to take if a NMD’s refusal or treatment makes him/her a danger to self or to others.

0600-502.20 HIV/AIDS Testing and Disclosure of HIV/AIDS Information

Summary of revisions made:

This policy guide was revised per the following legislative changes that became effective January 1, 2014.

§  Health and Safety Code 121020 - permits the CSW to consent to HIV testing and treatment for infants 0-12 months old; defines the treatment as emergency medical care and; requires the CSW to provide contact information for the biological mother to the physician.

§  Welfare and Institutions Code (WIC) 369(h) - address that youth, 12 years of age or older, have the right to consent to and receive diagnosis and treatment of HIV/AIDS and that the CSW is authorized to inform the youth of this right.

§  WIC 16001.9(a)(26) - states that youth, 12 years of age or older, have the right to access age-appropriate, medically accurate information about the prevention and treatment of HIV/AIDS.

This policy guide was updated from the 03/19/12 version, as part of the Policy Redesign, in accordance with the DCFS Strategic Plan.
