The Nowthen City Council conducted a Public Hearing and Regular City Council Meeting on Tuesday, July 8, 2014 at 7:00 PM, at the Nowthen City Hall, 19800 Nowthen Blvd NW, Nowthen, Minnesota.

PUBLIC HEARING

1). Revocation of Conditional Use PermitIssued to Jerry Bauer on March 15, 1994 by the Burns Town Board for a home-extended septic installation business on property owned at 21226St. Francis Blvd, NW. - Mayor Schulz opened the public hearing. City Planner, Liz Stockman stated that the Attorney would like the Public Hearing be continued to the rescheduled 2014 August meeting on August 11, 2014 to allow the City to further prepare its findings.

No other comments were presented by the public. Meyer made a motion to continue the Revocation of Conditional Use Permit to the rescheduled 2014 August City Council Mtg. date of August 11, 2014 at 7:00 PM, to allow the City to further prepare its findings; Scheffler seconded. All in favor; motion carried.

CITY COUNCIL MEETING

Approve/amend the meeting agenda – Rainville made a motion to approve the agenda with the removal of item 3.c (Nowthen Alliance Church Parking lot); Schulz seconded. All in favor; motion carried.

1). Sheriff Update: Lt. Wayne Heath provided a report of calls for Sheriff’s service for the month of June 2014.

2). Floor Items: - No floor items were addressed

3). Planning and Zoning

a). ROSP Proposed Ordinance – Review of revised draft and concept maps – Stockman said that the intent of the discussion tonight was to review the examples of ROSP subdivisions. Does the City Council want to ask the City Engineer to prepare additional examples of ROSP subdivisions? We do not have a direct comparison of a concept plan of what is proposed. Meyer thinks that we should give a concept plan of a property in Nowthen. Without that we won’t have an idea of how this will work. About 10 hours of Nelson’s time to provide concept plans. Pull some examples from Elk River. Scheffler doesn’t know how many more examples are needed? He doesn’t think that we should have Nelson do anymore work just to provide another example.

Need to schedule an informational meeting. No advantage of having another joint meeting until after the informational meeting. Informational session will be scheduled sometime in October. The date of the Informational Open House will be discussed at the August Council Meeting.

b). Roy and Monica Munter for an IUP to operate an extended home occupation, Concrete Etcetera at 19320 Burns Parkway NW (PID 29-33-25-13-0001) – Stockman said that the MPCA is requiring that they cap the fill somehow and they would like everything cleaned up by the end of August. She included some provisions to the MPCA’s requirements as part of the conditions of approval of the IUP. Stockman doesn’t feel there would be any conflicts with her recommended conditions and the MPCA regulations. Rainville would say 7 days on item #10. Meyer made a motion to approve the IUP request by Roy and Monica Munter to operate an extended home occupation at 19320 Burns Parkway, with the following conditions:

1. The property lines are staked by a registered surveyor.

2. All parking areas are setback a minimum of five (5) feet from the property lines.

3. The outdoor storage areas are setback a minimum of twenty (20) feet from side lot lines and thirty-five (35) feet from the rear lot line in accordance with Zoning Ordinance requirements.

4. All business-related vehicles and equipment are kept within the side or rear yards, behind the front of the home.

5. The hours of operation shall be 6 AM to 7 PM, Monday through Friday, year-round.

6. Natural vegetation is planted and maintained along the southerly lot line to screen the neighbor’s house and deck from view of the outdoor storage area.

7. Any future sign is limited to a maximum six (6) square foot size and shall be approved by the City.

8. No more than two (2) full-time or (4) part-time on-site employees or subcontractors may be permitted on the property at any given time.

9. The closure of the existing concrete rubble/construction debris as well as on-going maintenance on site complies with MPCA mandated directives.

10. Concrete rubble and construction debris may only be stockpiled on site within trucks, trailers or containers on a temporary basis for periods of time not exceeding 7 days.

11. The condition of the property is disclosed to potential buyers via a deed notice filed with the Anoka County Recorder. A copy of the deed notice is submitted to the City no later than August 31, 2014.

12. Any change or intensification of the property use, or activities not permitted by the Interim Use Permit issued shall require an amended IUP.

13. Termination of the IUP will occur at the time the property is sold outside of the family, upon violation of any condition, following discontinuation of the business or use for one (1) year, or a change in regulation by the City Council.

14. Property Owners shall reimburse the City for all administrative, legal and professional costs incurred in consideration of this request.

Rainville seconded Meyer’s motion to approve the request IUP request by Roy and Monica Munter to operate an extended home occupation at 19320 Burns Parkway, with the conditions listed above. All in favor; motion carried.

c). Nowthen Alliance Church Parking lot – Removed indefinitely.

4). Consent Agenda

1.1 Approve the June 10, 2014 City Council Meeting Minutes

1.2 Financial Report

1.3 Approve All Audited Bills Claim #8835 through Claim #8886, plus Net Distribution reports dated June 10th, June 16th, and June 30th, 2014.

1.4 Adopt Resolution 2014-10, (Resolution Appointing Election Judges for Primary Election).

1.5 Approve Temporary Liquor License – Ramsey Lions

Scheffler made a motion to approve the consent agenda, as presented; Rainville seconded. All in favor; motion carried.

5). Council Items:

a). Quotes to install pipe ballards inside and out of Recycle Bld. – Meyer made a motion to approve Clauson Contracting LLC’s proposal to install pipe ballards inside and out of the recycling center, with the stipulation that they are installed 48” inches deep at an amount not to exceed $1,600.00; Scheffler seconded. All in favor; motion carried.

b). Nowthen Memorial Park Restroom Improvements – Schreder stated that he did find some documentation from the DNR, which does require full compliance with the ADA regulations in the restrooms at Nowthen Memorial Park, as per our Grant Agreement with the DNR. Schreder recommends that the City make the necessary renovations to the interior of both restrooms to be compliant with the Minnesota Accessibility Code. This is required by the grant agreement with the DNR as well as Minnesota State Code.

The work will involve adding compliant grab bars, removing some interior partitions, adding others and possibly removing and replacing an exterior door in order to reverse the direction in which it swings and other improvements necessary by ADA regulations. Schreder will talk with some contractors and come back with some options.

c). Animal Control Contract – Update and appointment of Council for approval – LaDoucer stated that submittal of proposals for Animal Control Services is until July 11th, She requested that the Council appoint two Council Members to review proposals and approve. Rainville made the motion to appoint Schulz and Scheffler to review the proposals and make the decision to approve one; Meyer seconded. All in favor; motion carried.

d). Full Time Maintenance Worker – Schulz made a motion to publish an advertisement for an experienced full time maintenance worker, with a minimum starting wage of $18 per hour and salary based on experience; Meyer seconded. All in favor; motion carried. Pilon and Meyer will review applicants and make recommendation for hiring.

e). Temporary Office Help – Need to define interpretation of EMB and FTO accumulation – Pilon made a motion that Extended Medical Benefits can be used to supplement staff hours for an injury or illness during hours that they are unable to work, as long as the EMB criteria is met and that the leave is a continuation of the same injury or illness. EMB also cannot be accrued during the time it is being used. FTO will only accrue for the actual hours worked during the use of EMB; Schulz seconded. All in favor; motion carried.

f). Change August Meeting Date (due to elections August 12, 2014) – Schulz made a motion to keep the Workshop on August 7th and change the date of the August meeting to Monday, August 11, 2014 at 7:00 PM; Meyer seconded. All in favor; motion carried.

6). Introduction of New Items: No new items were introduced

Scheffler made a motion to adjourn the meeting at 8:35 PM; Rainville seconded. All in favor; motion carried.
